Terms of Sale
These Terms of Sale define the subscription, activation, and cancellation terms for Cloud-Hexagone storage services. They complement the CGU and apply to both individual and business customers.
1. Scope
These CGV apply to any order placed on the Cloud-Hexagone website or through sales. Validation of an order or payment constitutes acceptance.
Cloud-Hexagone reserves the right to modify these terms; new conditions will apply after notification.
2. Orders and validation
Any order becomes effective after payment validation by Stripe and confirmation by email.
Services are activated automatically after payment, except in case of anti-fraud checks or manual review.
If there is doubt about identity or compliance, Cloud-Hexagone may request supporting documents or cancel the order.
3. Pricing, billing, and renewal
Prices are listed in euros. Rates are excluding taxes for businesses and including taxes for individuals; the total amount is shown before payment and appears on the invoice.
Services are billed monthly or annually and renew automatically at the end of the period, unless canceled via the client area before the renewal date.
Cancellation ends the service at the end of the current period; no partial refund is issued.
If pricing changes, the customer is informed at least 15 days in advance and may cancel before the change takes effect.
4. Payment and security
Payments are made by card or SEPA debit via Stripe, certified PCI-DSS. No banking data is stored by Cloud-Hexagone.
In case of payment failure or delay, a reminder is sent; the service may be suspended after 5 days and deleted after an additional 7 days without payment.
Any abusive chargeback leads to immediate termination and account blocking.
5. Service delivery and activation
Vaults are provisioned automatically after payment validation. A confirmation email containing access credentials is sent.
Average delivery time is a few minutes, except in case of technical incidents or anti-fraud checks.
The service is considered delivered upon sending access credentials.
6. Right of withdrawal
Pour les consommateurs, un droit de retractation de 14 jours peut s appliquer selon la loi. En cas d activation immediate du service, une case a cocher distincte est requise pour demander l execution immediate et renoncer expressement au droit de retractation, lorsque la loi le permet.
La preuve de ce consentement est conservee (horodatage, adresse IP, user-agent, version des CGU/CGV/politique de confidentialite).
Professionals do not benefit from the right of withdrawal.
6 bis. Dispositions clients professionnels (B2B)
Pour toute commande passee au nom d une entreprise, le client declare agir pour le compte de cette entreprise et fournir des informations exactes de facturation (raison sociale, adresse complete, SIRET, representant, email professionnel, telephone).
Le client professionnel confirme l acceptation des CGV professionnelles via une case dediee.
7. Refunds, credits, and service vouchers
Except where legally required, paid amounts are non-refundable. Cloud-Hexagone may, at its discretion, grant a commercial credit or service voucher.
Any granted credit or voucher does not constitute an admission of liability and is neither transferable nor redeemable for cash.
8. Commercial limitation of liability
To the extent permitted by law, Cloud-Hexagone is not liable for indirect damages, data loss, business interruption, loss of revenue, or commercial harm.
Cloud-Hexagone's total liability is capped at the amounts effectively paid by the customer during the 12 months preceding the triggering event.
9. Suspension, termination, and deletion
Cloud-Hexagone may suspend or terminate a service in case of non-payment, fraud, unlawful use, security risk, contractual breach, or request from a competent authority.
A expiration ou resiliation, les donnees d exploitation du service sont supprimees sous 30 jours, sauf obligation legale de conservation.
Restent conserves pendant les durees legales : donnees de facturation/comptables (10 ans), journaux techniques et de securite (jusqu a 12 mois), et traces contractuelles strictement necessaires a la preuve.
10. Miscellaneous provisions
Technical logs, timestamps, support tickets, and electronic communications are admissible between the parties unless proven otherwise.
If any clause is invalid, the others remain in force. Failure by Cloud-Hexagone to enforce a right does not constitute a waiver. In case of translation discrepancy, the French version prevails.
