Terms of Use
These Terms of Use and the Privacy Policy govern access, use, and data handling for Cloud-Hexagone storage services. By creating an account or using our services, you acknowledge that you have read, understood, and accepted these terms.
1. Purpose and scope
These terms define the respective rights and obligations of Cloud-Hexagone and any customer using its storage services, including related options.
Any subscription, order, or use of the service constitutes full acceptance of these Terms. The terms may be updated to reflect legal, technical, or commercial changes; any material change will be notified before it takes effect.
2. Account creation and customer obligations
Creating an account requires verifiable identity information, a valid email address, and accurate contact details. The customer must keep this information up to date.
The customer is responsible for keeping credentials confidential. Any action performed through the account is presumed to be made by the customer unless a compromise is reported in advance.
Providing false information or creating multiple accounts to bypass limits or suspensions is prohibited.
3. Acceptable use of the services
Cloud-Hexagone services must be used for lawful purposes in compliance with applicable laws.
- Sending spam or unsolicited emails;
- Hosting, storing, or sharing illegal content (child exploitation, hate incitement, copyright infringement, etc.);
- Storing or distributing malware or hacking tools;
- Providing public proxy/VPN services or open relays without authorization;
- Performing network attacks (DDoS, brute-force, port scanning, etc.);
- Any action that may compromise infrastructure stability or security or other customers.
Any abuse may lead to immediate suspension of the service or account, without prior notice, within the limits permitted by law.
4. Backups and customer responsibility
The customer remains solely responsible for backing up and preserving their data. Backup, versioning, or export features, when available, do not replace a proper backup strategy. Cloud-Hexagone does not guarantee data recovery in case of deletion, corruption, or handling errors.
5. Availability, maintenance, and performance
Cloud-Hexagone uses reasonable efforts to ensure service availability. Scheduled maintenance may be required to ensure infrastructure security and performance.
In case of a critical incident, the technical team intervenes to restore the service as quickly as possible. Performance depends on allocated resources and the customer's configuration.
6. Security and responsibility
The customer is responsible for content, access, and configuration of their storage space. They must maintain an adequate security level (strong passwords, access management, key rotation, etc.).
Cloud-Hexagone cannot be held responsible for misconfigurations, data loss, or improper use. In the event of an attack or compromise, the affected access may be isolated or suspended.
7. Billing and payments
Services are billed according to the selected cycle (monthly or annual). Payment and billing terms are detailed in the CGV.
In case of non-payment, the service may be suspended after reminders and deleted after a reasonable period.
8. Technical limits and resource usage
Cloud-Hexagone plans are subject to quotas and technical limits (storage, bandwidth, API, number of users, etc.) defined by the subscribed plan.
Some features may be restricted by design. Any excessive or abusive use of resources is prohibited.
In case of overuse or service degradation, Cloud-Hexagone may apply temporary limits or propose a more suitable plan.
9. Suspension and termination
Cloud-Hexagone may suspend or terminate any account in the following cases:
- Violation of these Terms or applicable laws;
- Repeated payment failure or fraud;
- Abusive or excessive use of resources;
- Attempted exploitation of security flaws or unauthorized access;
- Illegal activities or infringement of third-party rights.
Immediate suspension may be applied if a proven threat to the infrastructure or other customers is identified.
10. Support and assistance
Technical support is available by ticket or email. Requests are handled by priority and response times vary depending on the incident.
Abusive or disrespectful behavior toward support may lead to account suspension.
11. Personal data and privacy
Cloud-Hexagone collects only the information required to create the account and manage the service: name, email, IP address, technical logs, and billing data.
This information is used for billing, service management, security, and support. No personal data is sold or shared with unauthorized third parties.
Billing data is retained for 10 years. Account data is kept during the contractual relationship and up to 3 years after closure. Technical logs are kept for up to 12 months.
In accordance with the GDPR, you have the right to access, rectify, erase, restrict, object to, and port your data. To exercise your rights, contact [email protected].
Payments are processed by Stripe, the controller of payment data under PCI-DSS standards.
12. Cookies and analytics
This site uses essential technical cookies (authentication, language, cart). Analytics cookies may be used to improve the experience.
You can disable non-essential cookies from your browser. No browsing data is sold or used for commercial profiling.
13. Governing law and jurisdiction
These terms are governed by French law. In case of dispute, the competent courts are those of the jurisdiction of Cloud-Hexagone's registered office.
In case of discrepancy between the French version and a translation, the French version prevails.
14. Limitation of liability and indemnification
To the extent permitted by law, Cloud-Hexagone is not liable for indirect damages, business interruption, loss of revenue, data loss, or reputational harm.
Cloud-Hexagone's total aggregate liability, for all causes combined, is capped at the amounts effectively paid by the customer during the 12 months preceding the triggering event.
The customer shall indemnify Cloud-Hexagone against any third-party claim related to its content, use, access, or breach of these Terms of Use.
15. Electronic evidence and claim period
Technical logs, connection traces, timestamps, support tickets, and electronic communications are admissible between the parties unless proven otherwise.
Unless mandatory law provides otherwise, any claim related to the service must be submitted within 12 months from the date the damaging event became known.
16. Subprocessing and service evolution
Cloud-Hexagone may rely on technical subprocessors for operations, maintenance, security, support, and billing, subject to appropriate confidentiality obligations.
Cloud-Hexagone may evolve service features, provided that essential functions of the current plan are not removed without a legitimate reason.
